El estado es responsable de proporcionar servicios públicos de Defensoría de Oficio, Representación Social y Servicios Jurídicos Asistenciales, señalados en la Constitución Federal y, por tanto en la Constitución Estatal. La Procuraduría Social es la dependencia que en Jalisco asume esas tareas, como queda establecido por su propia Ley Orgánica.
Su titular, cuya denominación es la de Procurador Social, depende en forma directa del Gobernador, cual dispone el Artículo 23 de la Ley Orgánica del Poder Ejecutivo del Estado.
